Wie Souver?nit?t dabei definiert werden kann und welche Dimensionen der Souver?nit?t von Nationalstaaten grunds?tzlich vorhanden sind, wird in Punkt 2 dieser Arbeit erl?utert. Dieser Punkt beinhaltet auch die Ausarbeitung eines neuen Souver?nit?tskonzeptes f?r Nationalstaaten, welches sich auf drei Dimensionen der Souver?nit?t st?tzt: ?Die begr?ndete Souver?nit?t ?Die innere Souver?nit?t ?Die ?u?ere Souver?nit?t Jeder dieser drei Dimensionen werden Bedingungen zugeordnet, deren Erf?llungsgrad Auskunft dar?ber gibt, in wieweit ein Staat tats?chlich als 'souver?n' gelten kann. Dieses Souver?nit?ts-Konzept findet nun in Punkt 3 Anwendung auf die der Europ?ische Union (EU). Die Arbeit untersucht auf Basis der EU-Vertr?ge, in wieweit die drei Dimensionen der Souver?nit?t bereits in der Europ?ischen Union im Verh?ltnis zu ihren Mitgliedsstaaten etabliert worden sind. Als Ergebnis steht das wird festgestellt, dass die EU und die Mitgliedsstaaten in ihrer heutigen Verfassung nach dem Konzept einer (freiwillig) 'geteilten Souver?nit?t' funktionieren. Die 'freiwillige' Teilung der Souver?nit?t durch die Mitgliedstaaten mit der EU wird in den nationalstaatlichen Verfassungen geregelt. In der vorliegenden Arbeit werden drei Beispiele f?r die ?bertragung von Hoheitsrechten durch die nationalstaatlichen Verfassung kurz skizziert, wobei jeweils ein Beispiel f?r explizite und implizite ?bertragung in der Verfassung (explizit: ?sterreich; implizit: Polen) sowie ein Beispiel f?r explizite ?bertragung mit einfachem Parlamentsgesetz (Vereinigtes K?nigreich) herangezogen wird.
